This website and the ‘Goodness’ mobile application (“App”) are provided by GoodApp Technologies Private Limited (“GoodApp”). These Terms of Use ("Terms") govern your access and use of GoodApp's website. Please see GoodApp’s Privacy Policy for further details on what information GoodApp collects from you and how GoodApp uses that information.

USE OF SERVICES

  1. TERM: You shall be able to support the campaigns & purchase the Certificate of Completion available on the App only upon creating a user account & completing the specific Campaign. You shall be able to access and use your account up till its deletion by you or GoodApp. You agree to create, access and/or use only one account, and not to share with any third party access to or information pertaining to your account.
     

  2. PERMITTED USERS: By accessing the website, you to be bound by these Terms. Only persons over the age of 18 years, who can form legally binding agreement(s) under Indian law, can use and access this website & App. A person under the age of 18 years may access the website & App only with the consent and supervision of their parent or legal guardian, provided that such parent or legal guardian agrees to be bound by the Terms. GoodApp reserves the right to refuse access to the website & App to any prospective user at any time without according any reasons for doing so.
     

  3. INTELLECTUAL PROPERTY RIGHTS: All the content featured or displayed on this website and App, and materials provided by GoodApp, are owned by GoodApp or its partners, vendors or licensors. All elements of the website & App and materials provided by GoodApp, are protected by copyright, trademark and other laws relating to intellectual property. You cannot use, copy, reproduce, republish, upload, post, transmit, distribute or modify such elements or materials in any way, without the prior written consent of GoodApp.
     

  4. PROHIBITED USE: While accessing the website & App or using the materials provided by GoodApp, you shall not: (i) violate applicable laws; (ii) engage in activities that will cause any wrongful loss or wrongful gain to any person; (iii) provide false or misleading information to GoodApp; and (iv) use or access the website & App and/ or materials in a manner not expressly permitted by GoodApp.
     

  5. TERMINATION: GoodApp may, in its sole discretion, terminate or suspend your access to its website & App, for any reason. If you no longer desire to use GoodApp’s website & App, you may delete your user account at any time.
     

  6. PAYMENT: Unless otherwise stated, all prices are quoted in Indian Rupees. You are responsible for paying the quoted price and applicable taxes at the time of supporting any campaign. If the payment fails, GoodApp will not recognise and make available the Certificate of Completion for any campaigns completed until the payment is received by GoodApp. GoodApp reserves the right to change the prices quoted at any time, at its sole discretion.
     

  7. MODIFICATIONS: GoodApp has the right to, at any time, in its sole discretion, cancel, delay, reschedule or alter the website & App and/ or the campaigns available through the same. You agree that GoodApp will not have any liability towards you for such an action.

 

ADDITIONAL TERMS

 

  1. BREACH: If you breach the Terms in any way, GoodApp may take such action as GoodApp deems appropriate to deal with the breach, including but not limited to, suspending your access to the website & App, and/ or initiating legal proceedings against you
     

  2. INDEMNIFICATION: You agree to indemnify, defend and hold harmless GoodApp and its directors, employees, officers, agents, vendors, associated third parties and other users from and against any claims, actions, expenses, losses, damages or demands arising out of or resulting from or in any way related to your use of GoodApp’s website & App. 
     

  3. SECURITY: While GoodApp will try to protect the security of your account and related information. It cannot guarantee that unauthorized third parties will not be able to defeat its security measures. Please notify GoodApp immediately of any compromise or unauthorized use of your user account by emailing info@goodness-project.com
     

  4. VARIATION: The Terms may be modified by GoodApp, at its sole discretion. GoodApp may notify its users about material changes via e-mail or through in-app notifications. The continued use of GoodApp’s website & App after changes have been made, signifies your agreement to the modified Terms. You must return to this page periodically to ensure familiarity with the most current version of the Terms.
     

  5. WAIVER: The failure of GoodApp to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. 
     

  6. ASSIGNMENT: You cannot transfer, sub-contract or otherwise deal with its rights and/or obligations under the Terms, without the prior written consent of GoodApp.
     

  7. SEVERABILITY: If any court or competent authority determines a provision of the Terms or part thereof to be unlawful and/or unenforceable, such provision/ part will be deemed deleted, and the other/ remaining provisions will continue in effect.
     

  8. ENTIRE AGREEMENT: The Terms, Privacy Policy and Disclaimer constitute the entire agreement between you and GoodApp, and supersede all previous agreements between you and GoodApp with respect to the use of this website & App.
     

  9. FEEDBACK: GoodApp welcomes suggestions, ideas, comments, and other feedback regarding its website & App and/or products & campaigns ("Feedback"). By submitting any Feedback, you grant GoodApp the right to use the Feedback without any restriction or compensation.

 

GOVERNING LAW AND JURISDICTION: The laws of India will govern The Terms, and any disputes relating to the Terms will be subject to the exclusive jurisdiction of the courts of Mumbai.

CANCELLATION & REFUND POLICY

Please understand the details of every campaign / service / certificate that you choose to support or purchase through the Website or App, all the details will be available prior to making any payments.

 

  1. CANCELLATION:  In the event that you would like to withdraw monetary support for any campaigns listed through website & App, or any other purchased Certificates / Services, you can raise a cancellation request within 5 business days of your purchase.

    A cancellation request can be raised with GoodApp by writing to us via e-mail on info@goodness-project.com You will be required to provide us your order number and reasons for cancellation.
     

  2. In the rare event that you do not receive the purchased Certificate via Email, please write to us with your order number at info@goodness-project.com to have the same delivered to your email inbox.
     

  3. REFUND: Refunds for purchases that are cancelled will be processed once we review the reasons shared for retraction of support.

    It usually takes 5 business days to review each case. Thereafter, we take 15 business days to cancel the purchase and process the refund. We will arrange for the refund within 20 business days provided the reasons are genuine and proved after investigation.

    Debit Card, Credit Card and Net-banking payments will be refunded to the same account from which the payment was made within 15 business days of us reviewing the cancellation request.
     

  4. NO CANCELLATION: The following Certificate purchased cannot be cancelled:

    • Certificate of Completion of Universal Ethics
       

  5. ​SPECIAL RULES: Please note that for certain certificates, products or marketing campaigns, special cancellation, return and refund rules may apply. Information regarding this is visible on the promotion banner, email or other digital communication through which the purchase is effected.

    This website & App is provided by GoodApp Technologies Private Limited on an ‘as is’ basis without any representations or warranties, express or implied.GoodApp makes no representations or warranties in relation to this website or the information and materials provided on this website.

    Without prejudice to the generality of the foregoing, GoodApp does not warrant that this website & App will be constantly available, or available at all, or its operation will be error free or the information on this website & App is complete, true, accurate or non-misleading.

    To the fullest extent possible pursuant to applicable law, GoodApp does not make any representations or warranties of any kind whatsoever, express or implied, in connection with these terms and conditions or the website & App or any of the content. Further, GoodApp disclaims all warranties, express, implied or statutory, including warranties pertaining to merchantability, including but not limited to warranties of merchantability, non-infringement or fitness for a particular purpose, except to the extent such representations and warranties are not legally excludable.

    GoodApp will not be responsible or liable (whether in contract, tort (including negligence) or otherwise) under any circumstances for any (i) interruption of business; (ii) access delays or interruptions to the website & App; (iii) data non-delivery, loss, theft, incorrect delivery, corruption, destruction or other modification; (iv) loss or damages of any sort incurred as a result of dealings with or the presence of third party website links on the site; (v) viruses, system failures or malfunctions which may occur in connection with your use of the website, including while accessing a hyperlink to or from third party websites; (vi) any inaccuracies or omissions in the content; or (vii) events beyond our reasonable control. GoodApp makes no representations or warranties that defects or errors will be corrected.
     

  2. LIMITATIONS OF LIABILITY:

    To the fullest extent permitted by law, neither GoodApp nor our subsidiaries, affiliates, partners, or licensors will be liable (whether under the law of contract, the law of torts or otherwise) for any indirect, special, punitive, incidental, or consequential damages of any kind (including lost profits) related to the website & app or your use thereof, even if GoodApp has been advised of the possibility of such damages. In no event shall GoodApp’s maximum aggregate liability exceed the lower of INR 500 or the value of the order place by you in respect of which the loss has occurred.
     

  3. RESONABLENESS:

    By using this website & App, you agree that the exclusions and limitations of liability set out in this website & App disclaimer are reasonable. If you do not think they are reasonable, you must not use this website & App.
